When you park your car, whether in a parking lot or by the sidewalk, you don’t expect to be hit, but these sorts of accidents do happen. As long as you have the evidence to prove the other truck hit your car and it wasn’t your fault a lawyer should be prepared to take on your case and file a damages claim on your behalf.
Of course you have to be able to provide sufficient evidence to prove the accident wasn’t your fault. It will be on this basis which a lawyer will decide if a satisfactory damages claim can be won on your behalf.
Damages You May Be Entitled To if a Truck Hits You While Parked
What damages you will be entitled to claim will depend on if you were injured when a FedEx truck, or any other truck hits your car. If the truck hit while being driven at speed and you were sitting in the car you may have been seriously injured and you may be entitled to include the following in your claim:
- the value of the damage done to your car;
- the value of your medical treatment up to now and until full recovery;
- any loss in income because you can’t work;
- if your injuries are severe and causing pain you may be entitled to a payment for this pain and suffering;
- punitive damages may be included if the driver’s action was considered to be deliberately negligent.
Evidence Needed to File a PI Claim When a Truck Hits Your Car While Parked
Before a lawyer is likely to take up your case you will need to have available evidence to prove the accident was caused by the driver. This could include any of the following:
- photos taken at the accident scene;
- eye witness reports;
- footage taken by nearby cams;
- receipts showing you have received medical treatment for your injuries;
- if available a police report showing the FedEx driver caused the accident;
- estimation of the cost of future medical treatment if required;
- car repair receipt;
- a written assessment from your employer of wages you have lost.
The more evidence you can provide the better as it means your personal injury lawyer has more proof to show you weren’t to blame for the other driver hitting your parked car. Your personal injury lawyer will take on the claim if there is a high chance of success.
Will a Lawyer Take My Case?
PI lawyers will assess every case before agreeing to take one on. In most states there is a statute of limitations in force which is normally 3 years. You are far more likely to meet this deadline if a PI lawyer works on your behalf.
An insurer is far more receptive to a PI claim filed by a lawyer than if you filed it on your own. Fill in the Free Case Evaluation form above and get your personal injury claim moving before it’s too late.
